These Terms of Service ("Terms") govern your use of the Cinevana website, waitlist, and — once launched — the Cinevana platform, apps, and services (together, the "Service"), operated by [Company legal name] ("Cinevana," "we," "us"). By using the Service, you agree to these Terms and our Privacy Policy.
1. Eligibility & accounts
- You must be at least 13 years old (or the minimum digital-consent age in your region) to use the Service, and at least 18 to enable monetization, payouts, or marketplace selling.
- You're responsible for your account credentials and for all activity under your account. Tell us immediately about any unauthorized use.
- One person per account; no impersonation of others.
2. Credits, plans & payments
- Paid plans (Creator, Pro, Studio) renew monthly until cancelled. You can cancel anytime; access continues to the end of the billing period.
- Credits are a license to use generation capacity, not currency. Unused credits roll over up to three times your monthly allowance while your subscription is active, and expire if your subscription lapses for more than 60 days.
- Credits and subscription fees are non-refundable except where required by law or where a generation fails due to a fault on our side (failed renders are automatically re-credited).
- Prices and credit rates may change with at least 30 days' notice; changes apply from your next billing cycle.
- Earnings converted to credits are subject to the same rules as purchased credits.
3. Your content & AI-generated content
- You own what you make. As between you and Cinevana, you retain all rights you have in content you upload and in AI outputs you generate on the Service, to the extent permitted by applicable law and our model providers' terms.
- License to us. You grant Cinevana a worldwide, non-exclusive, royalty-free license to host, store, transcode, display, and distribute your published content for the purpose of operating and promoting the Service. This license ends when you delete the content, except for content others have already remixed or licensed, and reasonable backup periods.
- Your responsibility. You must have the rights to everything you upload — including music tracks for the Music Video Generator, reference images, and likenesses. Do not upload or generate content using someone's face, voice, or identity without their permission.
- AI output disclaimer. AI models can produce similar outputs for different users and may occasionally produce inaccurate or unintended content. We don't guarantee that outputs are unique or non-infringing; you're responsible for how you use them.
- AI labeling. Content on Cinevana is understood to be AI-generated or AI-assisted, and we may apply provenance labels or watermark metadata as required by law or platform policy.
4. CastLock ID, characters & the marketplace
- Characters you build remain yours. If you license a character, style pack, or prompt through the marketplace, you grant buyers the usage rights described in the listing, and Cinevana a right to facilitate that transaction.
- Cinevana charges a marketplace fee (currently 10–15%) on completed transactions.
- You may not build CastLock IDs from real people without their documented consent, or from characters or performers you don't have rights to.
5. Prohibited content & conduct
You may not use the Service to create, upload, or share content that:
- Sexualizes or endangers minors in any way (zero tolerance; reported to authorities).
- Depicts real people in a false, sexual, defamatory, or deceptive way, including non-consensual deepfakes of any person.
- Infringes copyrights, trademarks, or other IP rights — including recreating protected characters, films, or performers you don't have rights to.
- Promotes violence, hatred, self-harm, or illegal activity, or constitutes harassment.
- Is designed to deceive — including fraudulent impersonation, scam advertising, or coordinated misinformation.
You also may not scrape the Service, resell generation capacity outside the plugin/API terms, interfere with security, or use the Service to build a competing dataset. We may remove content, suspend generation, or terminate accounts that violate these rules, and we use both automated and human moderation to enforce them.
6. Copyright complaints (DMCA)
We respect IP rights and respond to valid takedown notices. Send notices to our designated agent at dmca@cinevana.ai [replace and register an agent with the U.S. Copyright Office] with the information required by 17 U.S.C. §512. Repeat infringers will have their accounts terminated. Counter-notice procedures are available if you believe content was removed in error.
7. Monetization & payouts
- Creator earnings (subscriptions, tips, ad share, marketplace sales) accrue to your creator balance and are paid via our payment partner, subject to identity verification, minimum payout thresholds, and applicable taxes.
- We may withhold or reverse earnings connected to fraud, chargebacks, artificial engagement, or Terms violations.
- Revenue-share percentages are described on our pricing page and may be updated with 30 days' notice.
8. Third-party services
Generation runs on third-party AI models (including ByteDance/BytePlus Seedance and other engine partners) and your use is also subject to those providers' acceptable-use policies. Plugins are provided by third parties; we're not responsible for their content or conduct, and plugin developers must follow our developer terms.
9. Termination
You can stop using the Service or delete your account at any time. We may suspend or terminate the Service or your account for violations of these Terms, legal requirements, or extended inactivity, with notice where practicable. Sections that by their nature should survive (content licenses already granted, payment obligations, disclaimers, liability limits) survive termination.
10. Disclaimers
The Service is provided "as is" and "as available." We disclaim all warranties to the maximum extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee uninterrupted service, that any content will remain available, or any level of earnings, views, or audience.
11. Limitation of liability
To the maximum extent permitted by law, Cinevana will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, data, or goodwill. Our total liability for any claim will not exceed the greater of $100 or the amount you paid us in the 12 months before the claim.
12. Indemnity
You agree to indemnify Cinevana against claims arising from your content, your use of the Service, or your violation of these Terms or any third party's rights.
13. Governing law & disputes
These Terms are governed by the laws of [State/Country], without regard to conflict-of-law rules.
